Terms and Conditions

1. PROMOTER AND TERMS OF ENTRY

  1. The promoter and operator of the F1 Esports Series is Formula One Digital Media Limited of No. 2 St James’s Market, London, SW1Y 4AH (“F1”).
  2. By entering the F1 Esports Series, you (a “Driver”) are accepting the following terms and conditions (the “Terms and Conditions”):
    1. these terms and conditions, which set out the non-sporting rules of the F1 Esports Series (the “Competition Rules”);
    2. the sporting rules of the F1 Esports Series, which consists of the Online Rulebook from time to time which can be found at https://f1esports.com/rules and any updated or supplemental sporting rules relating to the Pro Draft and/or Pro Series which will be issued to all relevant Drivers ahead of the round to which they relate (together the “Sporting Rules”);
    3. any handbook(s) for Drivers or for parents/guardians relating to the F1 Esports Series, which can be found at https://f1esports.com/rules (each a “Handbook”); and
    4. the terms of use and the privacy policy of f1esports.com (the “Website”) as updated from time to time, which are available at https://f1esports.com/legal-notice. Please note that any other website used in relation to the F1 Esports Series will also have terms of use, which will apply to your use of such site and F1 is able to take no responsibility for such site(s), their terms or use or any related liability.
  3. All Drivers competing in the Pro Draft (as defined in section 3a) below) (and, additionally, in the case of Drivers competing in the Pro Draft under the Eligible Age (as defined in the Online Rulebook), such Driver’s parent or guardian) will be required to enter in to a written contract as a pre-condition to participating in the Pro Draft, and such contract will include:
    1. the Terms and Conditions;
    2. acknowledging that the Pro Draft and Pro Series will be filmed and that F1, its group companies and their licensees will be entitled to use and exploit footage of the F1 Esports Series;
    3. agreeing to participate in publicity and media activities relating to the F1 Esports Series; and
    4. consenting to F1, its group companies and their licensees using the Drivers’ image, including but not limited to the Driver’s name, voice, image, slogan, likeness, biography, statistics and performance in the F1 Esports Series and still and moving images of the Driver, and assigning any intellectual property created during the F1 Esports Series.

2. ELIGIBILITY, HOW TO ENTER AND ENTRIES

  1. The F1 Esports Series is open to Drivers aged 16 and over and who meet the eligibility criteria set out in the Online Rulebook.
  2. To enter the F1 Esports Series, Drivers must follow the instructions in the “How to Enter” section in the Online Rulebook.
  3. F1 and its employees, agents and/or representatives shall not be responsible for:
    1. any actions taken using a Driver’s password (and the Driver is responsible for the safety and security of his/her password);
    2. any entries which are delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    3. lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified.
  4. Once submitted, entries become the sole property of F1 and will not be acknowledged or returned. F1’s computer record of the entry will be considered to be the official entry. In the event of a dispute as to any entry, the authorised account holder of the email address used to register will be deemed to be the entrant to the F1 Esports Series (and this will be used to match the registration of the device/console on the Website).

3. STAGES AND QUALIFICATION

  1. The F1 Esports Series consists of:
    1. a public online qualification round (“Online Qualification”);
    2. a live Pro Draft event in the United Kingdom (the “Pro Draft”); and
    3. a series of live events, to take place at such location and on such dates as to be confirmed by F1 (the “Pro Series”), and as more particularly set out in the Sporting Rules from time to time.
  2. Drivers that qualify through Online Qualification will be notified via email (using the email address provided during registration) sent within 72 hours following the end of the Online Qualification Period or Wildcard Online Period (as defined in the Sporting and Qualifying Rules). It is the sole responsibility of Drivers to notify F1 if his or her e-mail address has changed. To do so, click on the ‘Contact’ link on the Website, then follow the instructions.
  3. If, after F1 has made reasonable efforts to make contact with a Driver who has qualified for the Pro Draft by any qualification method (each a “Qualifying Driver”) and within a reasonable period of time, such Qualifying Driver (and, additionally, in the case of Qualifying Drivers under the Eligible Age, such Qualifying Driver’s parent or guardian) (i) has not confirmed to F1 that they will be attending the Pro Draft and demonstrated that they are willing and able to attend the Pro Draft (for example by providing documents demonstrating the right to travel to the relevant location) or (ii) does not in fact attend the Pro Draft at the time and place specified, F1 may replace such Qualifying Driver with another Driver to proceed in the F1 Esports Series in its discretion. Where reasonably practicable, F1 will replace Drivers that qualify through Online Qualification with the next highest scorer from the relevant qualification method until the requisite number of Drivers for the Pro Draft has been achieved.
  4. F1 will have no responsibility to any Driver who has not responded to its communication or that fails to demonstrate that they are willing and able to attend the Pro Draft within a reasonable time ahead of the Pro Draft.
  5. F1 will arrange, at its own expense, reasonable economy travel and accommodation on a shared occupancy basis for Drivers competing in the Pro Draft only (“Pro Draft Qualifiers”) (and, additionally, in the case of Pro Draft Qualifiers under the Eligible Age, that Driver’s parent or guardian) and shall pay each Pro Draft Qualifier and parent/guardian an allowance of £20 per day (or local equivalent) in respect of their personal expenses at the Pro Draft. Food and refreshments will be provided for Pro Draft Qualifiers at the Pro Draft. Pro Draft Qualifiers are solely responsible for any and all expenses relating to participation in the F1 Esports Series (including acceptance of any prize) not specified herein.
  6. Without prejudice to the disputes procedures set out in the Sporting Rules, the decision of F1 and its nominees regarding any aspect of the F1 Esports Series is final and binding and no correspondence will be entered in to.
  7. F1 reserves the right to alter, amend or supplement these Competition Rules from time to time as it considers desirable to do so and, in particular, once more specific information is revealed about the Pro Draft and Pro Series.
  8. F1 reserves the right at any time to modify or discontinue, temporarily or permanently, this F1 Esports Series with or without prior notice for reasons outside its reasonable control. In the event that F1 permanently discontinues the F1 Esports Series pursuant to this paragraph, Drivers in the F1 Esports Series shall be released from their obligations to F1 under these Terms and Conditions.
  9. F1 shall not be liable for any failure to comply with its obligations relating to this F1 Esports Series where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

4. PUBLICITY

  1. Pro Draft Qualifiers participating in the Pro Draft (and those that go on to participate in the Pro Series) will be required to participate in publicity and media activity related to the F1 Esports Series and agree to do so.
  2. Pro Draft Qualifiers participating in the Pro Draft (and those that go on to participate in the Pro Series) will be required to participate in publicity and media activity related to the F1 Esports Series and agree to do so.
  3. The Pro Draft and Pro Series will be filmed and broadcast and each Pro Draft Qualifier acknowledges that F1 shall be entitled to use any such footage in its discretion.
  4. Each Pro Draft Qualifier consents to the use by F1 and its related F1 group companies, and their licensees for an unlimited time, of Pro Draft Qualifiers name, voice, image, slogan, likeness, biography, statistics and performance in the F1 Esports Series and still and moving images of the Driver without additional compensation or prior notice and, in entering the F1 Esports Series .

5. PERSONAL INFORMATION

  1. By entering the F1 Esports Series, each Driver agrees that any personal information provided by them shall be:
    1. processed and used in accordance with the F1 Esports Series Privacy Policy, which is available at https://f1esports.com/legal-notice; and
    2. used by F1 and their respective agents and suppliers to administer the F1 Esports Series and to enable F1 to promote the Competition in any media (including, without limitation, television and online broadcast, publishing channels and on F1’s and its partners’ social media pages); and
    3. used for any additional activities that you have consented to, for example if you have agreed that F1’s partners can contact you, then your data will also be used in accordance with such consents. Where you have agreed that F1’s partners can contact you, your data will be passed to such partners.

6. LIABILITY

  1. F1 accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the F1 Esports Series or accepting any prize. F1 further disclaims any liability for any injury or damage to your or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the F1 Esports Series save to the extent that (i) death or personal injury is caused by F1’s negligence; (ii) such liability arises from fraud or fraudulent misrepresentation; or (iii) for any other reason or by any cause which cannot be excluded by law.

7. GOVERNING LAW AND LOCATION

  1. The F1 Esports Series is operated by F1 in the UK under English law and, to the extent permitted by law, any legal disputes are subject to the jurisdiction of the English courts.
  2. Regardless of this, Drivers may have statutory and/or consumer rights where they live which may apply and Drivers’ local law may apply in some circumstances.
